Geophysical Hazards, Section 3-Coastal Processes: Development and resource extraction activities shall be sited and conducted to minimize accelerated coastal erosion or adverse impacts to coastal processes which could contribute to increase geophysical hazards. It is inconsistent because it does not minimize accelerated coastal erosion or adverse impacts to coastal processes which could contribute to increased geophysical hazards. By permanently removing the dredged material and incorporating it into the resurfacing project, it would accelerate coastal erosion. Applicant adoption of the following alternative measure into the project description would achieve consistency with the policies cited above. Alternative Measure 1: QAP will not place the 1,500 cubic yards of dredged materials in with the airport resurfacing stockpile and will return the materials back to their original location to minimize erosion. Adoption of Alternative Measure 1 would achieve consistency with BS CRSA enforceable policy E. Geophysical Hazards, Section 3.Coastal Processes, by returning dredged materials to minimize accelerated coastal erosion, rather than the proposed incorporation of materials into the resurfacing project. Example 2 (From Robin Swinford, DNR Div. of Mining, Land & Water, Southcentral Regional Office) DMLW objects to the project as proposed and recommends it be found inconsistent with the ACMP, unless the following alternative measure is adopted. This alternative measure #1 is necessary to ensure consistency with the Statewide Standards for Coastal Access (11 AAC 112.200) and the Kenai Peninsula Borough Coastal Management Plan Enforceable Policies 4.4 Public Access. In its present position the private boardwalk decreases public access to the state-owned island. In addition to physically impeding access along the south side of the island, the location of the private boardwalk on the island gives the appearance that the island is exclusively for the applicants private access, as opposed to public access. The pilings and boardwalk must be removed from the island and relocated to maximize the distance between the boardwalk and the island without impeding the navigation channel to the south. The applicant must adhere to the minimum and maximum setbacks from the island and navigation channel to be provided by the Division of Mining, Land and Water in the forthcoming Tideland Lease, if approved. Rationale: This alternative measure is necessary to maintain coastal access to, from, and along the state-owned island. Example 3 (From Thede Tobish, Senior Planner/Coastal District Coordinator, Municipality of Anchorage) The Municipality of Anchorage Planning Department has reviewed the subject project for consistency with the Anchorage Coastal Management Plan (ACMP). The State of Alaska, Department of Transportation proposes to reconstruct East Dowling Road from Lake Otis Parkway to Norm Drive and to construct a Dowling Road extension from Norm Drive east to a new intersection with the recently constructed Abbott Loop (Elmore) Road. The new roadways will include pedestrian bike lanes and pathways on both sides of the right-or-way, improved intersections at East Dowling and Lake Otis, and a new intersection at Abbott Loop and East Dowling. The reconstruction section of East Dowling will be developed as an urban roadway with curb and gutter and standard storm drain systems while the new road section will be constructed as a rural road with a surface runoff design to include grass swales and wetlands for treatment. The applicant proposes to implement a surcharge road prism with steep fill slopes and plans include fin drains or equalizer culverts to minimize impacts to contiguous wetlands. The project is located within the Anchorage Coastal Zone; however, no District Enforceable Policies are applicable to this site. The applicant has presented consistency certifications for the applicable Statewide Standards. The MOA objects to the applicant's consistency certification. As proposed, the project is not consistent with Statewide Standard 11 AAC 112.280 (1) & (2) and 11 AAC 112.300 (b) 3. As presented the project description does not list necessary or relevant Best Management Practices (BMPs) that would provide project minimization to adjacent wetlands and local wildlife. Without these BMPs the construction process for this road could contribute to disruption of known surface and groundwater patterns and add new sediment sources to these areas. In order for this proposal to achieve consistency with the above sections of the Statewide Standards, the applicant should adopt and include the following alternative measures in the project description and final design: Silt fences, hay bales, or similar erosion filters shall be placed at the toe of new fill slopes and maintained throughout the road construction project. New fill side slopes shall be stabilized with jute matting and/or native vegetation in the same growing season as fill placement. Clearing, site preparation, and/or placement of initial fill shall be prohibited in the bird nesting timing window of April 15-July 1, in order to minimize impacts to migratory bird nesting in the adjacent native habitats. [Fill and construction can proceed if the fill footprint is substantially cleared and grubbed before the April 15 timeframe.] Final location of equalizer culverts and fin drains shall be identified on as-builts and in the final project description in order for these to be located in the field and for their success to be monitored. If the applicant adopts these alternative measures, this action would achieve consistency with Alaska Statewide Standards 11 AAC 112.280(1) & (2) and 11 AAC 112.300 (a) 3 & 9. The applicant should present the final design to the Municipality's Floodplain Management Office for a floodplain permit determination prior to initiation of construction.
